We use technologies that are considered automated decision-making or profiling. We will not make automated decisions about you that would significantly affect you, unless such a decision is required under a contract concluded with you, we have obtained your consent or we are legally obliged to use such technologies. Information on your right to object in this regard can be found below under Rights as a data subject.
Some of the recipients of your personal data are located outside your country or have branches in countries where data protection laws may provide a different level of protection than the laws in your country. When transmitting data to such recipients, we provide appropriate guarantees.
Ads-UAE is part of the group of companies. As a rule, your personal data will be processed exclusively within the European Economic Area (EEA). If, exceptionally, personal data are transferred to companies of our group of companies in countries outside the European Economic Area (EEA), for which there is no adequacy decision of the European Commission, this transfer takes place on the basis of appropriate guarantees (e.g. standard data protection clauses adopted or approved by the EU Commission, together with other appropriate protective measures, if necessary).
We will only process your personal data on the basis of suitable guarantees from the European Economic Area (EEA) to third countries, i.e. Countries outside the EEA, transmitted. Third countries that offer an adequate level of data protection currently include Andorra, Argentina, Canada (for companies covered by the Personal Information Protection and Electronic Documents Act), Switzerland, the Faroe Islands, Guernsey, the State of Israel, the Isle of Man, Japan, Jersey, South Korea, New Zealand, Uruguay, the United Kingdom and South Korea. In the other cases, Ads-UAE provides the necessary guarantees, e.g. by concluding data protection contracts issued by the European Commission (e.g. standard data protection clauses (2010/87/EU, 2001/497/EC or 2004/915/EC)), with the recipients, or by other measures provided for by law. A copy of the documentation of the measures we have taken is available from us on request.
Your personal data will be stored by us and our service providers in accordance with the applicable data protection law, insofar as and as long as this is necessary for the processing purposes mentioned in this data protection declaration (further information on the processing purposes can be found under Purposes and legal bases of data processing as well as categories of recipients). We will then delete your personal data in accordance with our data retention and deletion policies or take measures to properly anonymize the data. Something different applies if we are legally obliged to keep your personal data longer (e.g. to fulfill legal obligations or for tax, accounting and audit purposes). In Europe, the retention periods are usually between 6 and 10 years (e.g. for contracts, communications and business letters). To the extent permitted or required by law, we restrict the processing of your data instead of deleting it (e.g. by blocking it). This applies in particular in cases where we may still need the data in question for further contract processing or legal prosecution or legal defense or their storage is otherwise required or permitted by law. The decisive criterion for the duration of the restriction of processing is then the statutory limitation or Retention periods. After expiry of the relevant statute of limitations or Retention periods, the data in question will be deleted.
The specific retention periods for personal data are documented in our data retention guidelines. How long we retain personal data may vary depending on the services we offer and depending on our legal obligations under applicable national law. The following factors typically influence the storage duration:
Necessity for the provision of our services: This includes, for example, the execution of the user contract with you, the maintenance and improvement of the performance of our services, the maintenance of the security of our systems and the maintenance of correct business and financial documents. On the basis of this general rule, most of our retention periods are determined.
Special categories of personal data: If it is the storage of special categories of personal data (these are personal data that reveal racial and ethnic origin, political opinions, religious or ideological beliefs or trade union membership, as well as the processing of genetic data, biometric data for the unique identification of a natural person, health data or data on the sexual life or sexual orientation of a natural person), a shortened retention period is usually appropriate.
Consent-based processing of personal data: If we process personal data on the basis of consent (including consent to extended storage), we store the data for the period necessary for the processing of your personal data in accordance with your consent.
Statutory, contractual or other similar obligations: Corresponding storage obligations may result, for example, from laws or official orders. It may also be necessary to store personal data with regard to already pending or future legal disputes. Personal data contained in contracts, communications and business letters may be subject to legal retention obligations, depending on national law.
Subject to possible restrictions under national law, you as the data subject have the right to information, correction, deletion, restriction of the processing and transfer of your personal data. In addition, you can revoke your consent once given and object to our processing on the basis of legitimate interests. You can also file a complaint with a supervisory authority.
Our responsible data protection supervisory authority is: Federal Trade Commission (FTC) 600 Pennsylvania Avenue, NW Washington, DC 20580 USA https://www.ftc.gov
Your rights in detail:
Revocation of consent: You can revoke your consent once given to the processing of your personal data by us at any time. As a result, we will no longer be allowed to process your personal data on the basis of your consent in the future. The legality of the processing carried out on the basis of the consent until the revocation is not affected by the revocation.
Information: You can request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if not collected directly from you, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on their details, whereby the right to information may be limited by national law.
Correction: You can request the immediate correction of incorrect or completion of your personal data stored by us and, taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data – also by means of a supplementary declaration.
Deletion: You can request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims, whereby the right to deletion may be limited by national law.
Restriction of processing: You can request the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have objected to the processing.
Data portability: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format and to transmit it to another person responsible (“right to data portability”).
If your personal data is processed on the basis of legitimate interests, you have the right to object to the processing of your personal data if there are reasons for this arising from your particular situation. This also applies to related profiling. If your personal data is processed by us for the purpose of direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising.
In principle, the processing of your application for the granting of data subject rights (e.g. information or deletion) is free of charge. For obviously unfounded or excessive applications, we reserve the right in individual cases to demand a reasonable fee (maximum up to the amount of our actual costs) in accordance with the applicable legal regulations or to refuse to process the application.
